Terms & Conditions
These terms govern business and professional use of the DPPora platform and form part of the agreement between the customer and the service operator.
October 17, 20261. Service operator
DPPora is operated by Christopher Alan Peachey, a self-employed professional registered in Spain, trading as Faro Digital Media, with Spanish tax identification number (NIF) Y0270240G and business address at Paseo de la Dirección 161, Madrid, 28039, Spain. References in these terms to “DPPora”, “we”, “us” or “our” refer to this service and its operator.
2. Business and professional use
DPPora is provided for business and professional use. By creating an organization, using the platform on behalf of an organization or purchasing a paid plan, you confirm that you are acting in connection with a trade, business, craft or professional activity and have authority to act for the organization where applicable. DPPora is not offered as a consumer service.
3. The DPPora service
DPPora provides tools for creating, maintaining, translating, versioning and publishing Digital Product Passports and related product records. Features may include organization profiles, product records, regulatory preparation fields, evidence and document storage, public passport pages, stable URLs and QR codes while hosted, validation tools and assisted translation. Features may evolve as the platform and applicable Digital Product Passport requirements develop.
4. Accounts and organizations
You must provide accurate account and organization information, maintain the security of your login credentials and promptly update information that changes. You are responsible for activity carried out through your account and for ensuring that people acting for your organization are appropriately authorized. You must notify us promptly if you reasonably believe an account has been compromised.
5. Product information and regulatory responsibility
You and the organization publishing a passport remain responsible for the accuracy, completeness, legality and regulatory suitability of all product information, declarations, identifiers, materials, evidence and other data submitted to DPPora. DPPora may provide structure, validation, explanations or automated assistance, but these tools do not replace the manufacturer’s, importer’s, representative’s or other economic operator’s legal obligations. You must review information before publishing it and determine which legal requirements apply to each product and market.
6. Uploaded materials and intellectual property
You retain ownership of product data, logos, images, documents and other materials that you lawfully provide. You grant DPPora the non-exclusive rights reasonably necessary to host, process, reproduce, translate, format and publish those materials in order to provide the service. You confirm that you have the rights and permissions required to upload and use them. DPPora’s software, interface, branding, original documentation and platform design remain the intellectual property of their respective owner.
7. Published passports and version history
When you publish a Digital Product Passport, information selected for public publication may become accessible through a public URL and QR code. DPPora may retain historical, read-only versions to provide an audit and lifecycle record. Updating a current passport does not necessarily remove information from an earlier version. You are responsible for checking the public passport before and after publication and for maintaining information that is required to remain current.
8. Acceptable use
You must not use DPPora unlawfully; submit malicious code; interfere with platform security or availability; attempt unauthorized access to accounts, systems or data; impersonate another person or organization; publish information you know to be materially false or misleading; infringe intellectual-property or privacy rights; or use the service to facilitate fraud, unlawful products or other prohibited activity. We may restrict or suspend access where reasonably necessary to protect the platform, other users or third parties.
9. Plans, pricing and taxes
Some DPPora functionality may be offered under free, trial or paid plans. The features, limits, billing period and price applicable to a paid plan will be shown before purchase. Prices are exclusive of taxes unless expressly stated otherwise. Spanish VAT will be applied where legally required. For qualifying business customers outside Spain, VAT or other indirect taxes may be treated according to the applicable place-of-supply, reverse-charge or other tax rules. Customers are responsible for supplying accurate billing and tax information.
10. Billing, renewal and cancellation
Where a plan is sold as a recurring subscription, the billing frequency and renewal terms will be disclosed before purchase. Unless the applicable plan states otherwise, a subscription may be cancelled so that it does not renew at the end of the current paid billing period. Cancellation does not ordinarily create a refund for a billing period that has already begun, except where we expressly agree otherwise or a refund is required by applicable law. Any plan-specific cancellation or refund terms displayed at purchase form part of these terms.
10a. 14-day free trial
When offered, Starter, Business and Professional include a 14-day free trial; Enterprise is excluded. The trial begins when the subscription is activated through checkout, not when an account is registered. A payment card is required. No subscription fee is charged during the trial, although your bank may verify the card. Unless you cancel before the trial ends, the selected monthly or annual subscription begins automatically and your payment method is charged the price and applicable taxes shown at checkout. You can cancel from the portal before the trial ends to avoid that subscription charge. Disabling the trial offer for new subscriptions does not shorten an already activated trial.
11. Changes to plans and pricing
We may introduce, modify or discontinue plans, features, usage limits or prices. Changes affecting an existing paid subscription will be communicated with reasonable notice where appropriate and will normally take effect from a future renewal rather than retrospectively altering an already-paid billing period.
12. Availability, maintenance and third-party services
We take reasonable measures to operate DPPora reliably and securely, but uninterrupted or error-free availability cannot be guaranteed. Maintenance, security incidents, network failures, regulatory changes or third-party infrastructure may affect availability. DPPora relies on external providers for functions such as hosting, databases, authentication, storage, security and other technical services. We may replace or modify providers where reasonably necessary.
13. Suspension and termination
We may suspend or terminate access where an account materially breaches these terms, creates a security or legal risk, remains unpaid where payment is due, or where suspension is reasonably necessary to protect DPPora or others. Where practical and appropriate, we will provide notice and an opportunity to remedy a breach. You may stop using DPPora at any time and may cancel a paid subscription in accordance with the applicable billing terms.
14. Data after cancellation or termination
Cancellation takes effect at the end of the trial or current paid billing period. The account then moves to Free: the oldest published passport remains publicly hosted, subject to other access restrictions, and all other published passports are disabled for public access. Their public pages and QR links no longer provide access to the passport content. Product records, passports and historical versions remain privately accessible in the workspace; cancellation does not delete them. Normal downgrades may be blocked if the lower plan cannot accommodate the published passports. Where a move to a lower plan is permitted, passports beyond its allowance cannot remain publicly hosted. Eligible passports may be hosted again after activating a subscription with sufficient allowance, subject to other access restrictions. You remain responsible for any legal obligation to retain or provide access to product information and should keep independent copies. Deletion requests may be sent to admin@farodigitalmedia.com; legally required records may be retained separately. Deleting your personal account removes your login, profile and access; it does not delete the organisation, products, passports or version history. If you are the last owner, renewal is cancelled and public hosting continues until the end of the paid subscription. If another owner remains, the organisation and subscription continue normally. After hosting ends, organisation records remain private for authorised continuity and recovery; there is no automatic 90-day deletion. Request permanent organisation and passport deletion at admin@farodigitalmedia.com. We verify authority before erasure or restoring access to a colleague; signing up alone grants no access to an existing organisation. Personal data is retained only while necessary for a lawful purpose, including legal recordkeeping and claims; statutory privacy rights remain available independently of organisation deletion.
15. Automated and translation features
DPPora may provide automated assistance, including translation, validation, suggestions or structured preparation of information. Automated output can contain errors or require contextual review. You remain responsible for reviewing output before relying on it or publishing it, particularly where product safety, legal obligations, regulatory declarations or technical specifications are concerned.
16. Liability
To the maximum extent permitted by applicable law, DPPora is not liable for indirect or consequential losses, loss of profits, loss of business opportunity, or losses arising from inaccurate customer-supplied data, customer publication decisions, misuse of the platform or reliance on automated output without appropriate review. Nothing in these terms excludes or limits liability that cannot legally be excluded or limited. Customers remain responsible for obtaining professional or legal advice where required for their products and regulatory obligations.
17. Changes to these terms
We may update these terms to reflect changes to the service, law, security requirements, pricing models or business practices. The effective date will be updated when a revised version takes effect. Where a material change affects an existing paid relationship, we will provide reasonable notice where required or appropriate.
18. Governing law and jurisdiction
These terms and the use of DPPora are governed by Spanish law. For business and professional customers, disputes arising from or relating to DPPora will be submitted to the courts of Madrid, Spain, unless another forum is legally mandatory or the parties expressly agree otherwise in writing.
19. Contact
Questions concerning these terms may be sent to admin@farodigitalmedia.com or by post to Faro Digital Media, Paseo de la Dirección 161, Madrid, 28039, Spain.
